Neil F. Horton

Neil specializes in estate planning and in trust and estate disputes. He is an experienced litigator, expert witness, and mediator. He has tried cases in the U.S. Tax Court and in California and Federal trial and appellate courts.

Certified as a specialist in both taxation law and in probate, estate planning, and trust law by the California Board of Legal Specialization, State Bar of California, Neil is a former chair and a current member of the Executive Committee of the State Bar of California Trusts and Estates Section, a fellow of the American College of Trust and Estate Counsel, former chair of the State Bar of California Judicial Nominees Evaluation Committee, a past president of the Alameda County Bar Association, and past chair of its Trusts & Estates Section.

Neil lectures frequently for the California Continuing Education of the Bar (“CEB”), most recently on Recent Developments in Estate Planning and Administration. He has also lectured for the California Center for Judicial Education and Research, the State Bar of California, the Annual East Bay Forum, the Bar Association of San Francisco, the Los Angeles County Bar Association, the Sacramento County Bar Association, the Alameda County Bar Association, the Contra Costa County Bar Association, the Practicing Law Institute, Marin County Bar Association, Legal Assistance to Seniors and the National Business Institute. He authored the chapter on substituted judgment petitions in the CEB book, “California Conservatorship Practice” and is a co-author of the CEB’s Action Guide on Capacity and Undue Influence. Neil also has contributed articles to the Estate Planning & California Probate Reporter, a publication of the Continuing Education of the Bar - California, and to the California Trusts and Estates Quarterly, a publication of the Trusts and Estates Section of the State Bar of California.

The State Bar of California has appointed Neil as a Special Examiner and has consulted him in disciplinary matters involving estate planning. The State Bar also awarded Neil the Wiley W. Manuel award for Pro Bono Legal Services.
