James T. Weiner

JAMES T. WEINER is an attorney (JD - 1991), a businessman (MBA- 1986) and an engineer (BS Chem Eng 1981).

I have been on the Board of Directors of the Southeast Michigan Land Conservancy (www.smlcland.org) since 2004.  I am a past president (5 years), past secretary, and current chair of its Land protection committee -- the committee that evaluates acquisitions.  I have overseen multiple acquisitions (fee and conservation easements), several "takings" of protected lands (condemnation for governmental purposes, expansion of pipeline easements through protected lands, etc.) and even wetland mitigation/prairie restoration projects (e.g. restoring AG land to wetlands or upland meadows).

Question: “How do you value trees in a forest?”  It took me almost a year to develop a simple method to value conserved trees. Using this method, as SMLC’s attorney and land protection specialist, I was successful in negotiating compensation for the "taking" of 100 trees in a forest (expansion of a pipeline easement) from $16,000 to $160,000

Professionally, I represent large and small organizations and individuals with a wide variety of environmental, corporate, construction, property and estate issues. I have forty-five (45) years’ experience include over thirty five (35) years as a practicing attorney and twenty (20) years as a chemical/environmental engineer in various industries including chemical manufacturing and auto-part manufacturing and metal finishing.

I taught environmental law at Wayne State University and construction law at Macomb Community College. I have a very general background environmental issues including transferring environmentally contaminated properties, environmental litigation; problems associated with contaminated sites and leaking underground storage tanks; hazardous and non-hazardous waste disposal and permitting in various states and Canada; permitting of waste treatment and air pollution control systems; industrial process engineering; auditing the environmental compliance of industry in the U.S. and Europe; Right-to-Know reporting; the handling, storage and transportation of hazardous materials; Employee Right-To-Know training and OSHA compliance.

I am available to provide you with legal services for your conservation efforts.
