Marcus Brooks

Marcus Brooks is a member of Winstead's Taxation, Employee Benefits & Private Business Practice Group. Marcus focuses primarily on tax controversy and tax litigation. He has represented clients in both income tax and estate tax matters at audit, before the IRS Appeals Office, before the U.S. Tax Court, in the U.S. District Court, and before the Fifth Circuit Court of Appeals. He has served as lead counsel in tax cases involving million dollar adjustments in both the U.S. Tax Court and U.S. District Court. Marcus has also represented clients in contested matters with state and local taxing authorities. In addition, Marcus routinely advises clients on federal and state tax planning matters.

Marcus has advised a broad range of taxpayers—including private and publicly-held companies, estates, and individuals—on a wide array of tax issues including complex partnership tax matters, corporate tax issues, international taxation and transfer pricing strategies, ERISA and qualified plan issues, nonqualified deferred compensation plan issues, state tax implications of interstate business activity in various states, exemption issues, and criminal tax matters.

After law school Marcus served as a law clerk for The Honorable James L. Dennis of the United States Court of Appeals for the Fifth Circuit.

Marcus also serves as an adjunct professor at Baylor University Law School, where he teaches a course covering federal taxation of closely held business entities, and in Baylor University's Masters of Taxation Program, where he teaches a course on federal tax research and procedure.
